Legal Terms & Master End-User License Agreement

Terms of Use

Effective Date: July 23, 2026 • Please read these Terms of Use carefully before using ScrollPic.

1. Acceptance of Legal Agreement

By downloading, installing, launching, accessing, or using the ScrollPic mobile application ("Application", "Software", "Service", "We", "Us", or "Our"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you are strictly prohibited from installing, accessing, or using the Application.

2. Limited License Grant & Scope

Subject to your strict compliance with these Terms, We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and execute the Application on personal mobile devices (iOS or Android) owned or controlled by you, solely for your personal, non-commercial media organization purposes.

3. Prohibited Uses & License Restrictions

You expressly agree that you will not, directly or indirectly, under any circumstances:

  • Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code or underlying algorithms of the Application.
  • Modify, adapt, translate, enhance, or create derivative works based upon the Application or any part thereof.
  • Sublicense, rent, lease, sell, redistribute, assign, or commercialize access to the Application or its Pro features.
  • Bypass, disable, or tamper with any digital rights management, feature gating, or licensing verification mechanisms within the Software.
  • Use the Application for any unlawful, fraudulent, or unauthorized purpose under applicable local, national, or international laws.

4. User Ownership of Media Content

You retain 100% intellectual property ownership, copyright, and full title to all photos, images, live photos, videos, audio files, documents, animations, files, and digital media assets of any format processed through the Application. The Application does not claim any ownership rights over your personal content, and because all processing is strictly local, zero content rights are assigned or transferred to Us.

5. User-Generated Content (UGC) & Media Liability Disclaimer

The Application operates purely as a local software utility tool allowing you to view, sort, compress, convert, and manage media stored on your personal hardware. You acknowledge and agree that:

  • You hold 100% legal responsibility and liability for the nature, legality, copyright ownership, and authenticity of all media content stored or processed on your device.
  • We are not a content publisher, host, or moderator, and hold zero liability or monitoring obligation for any copyrighted, illegal, infringing, or inappropriate material present in your gallery.
  • You agree to defend and hold harmless Us against any third-party copyright or IP infringement claims resulting from your media content.

6. Native OS Deletion Authorization & User Responsibility

The Application serves as a local productivity utility to assist you in sorting media. You acknowledge and agree that:

  • All media deletion requests initiated within the Application require your final, explicit authorization through your mobile device's native operating system deletion alert.
  • The Application does not have its own "Trash" or "Recycle Bin". When you delete a photo or video, the Application sends a native command to iOS or Android. It is the operating system (not the Application) that moves the media to your phone's native "Recently Deleted" album (where it typically remains for 30 days before permanent deletion, depending on your OS settings).
  • You bear sole legal responsibility for verifying and reviewing media files prior to granting system deletion permission. We hold zero ability, obligation, or liability to restore, recover, or retrieve permanently purged files.

7. Disclaimer of Warranties ("AS IS" & "WITH ALL FAULTS")

To the maximum extent permitted by applicable law, the Application is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. We, Our distributors, and licensors expressly disclaim all warranties, express, implied, or statutory.

8. Limitation of Liability for Media Loss

To the maximum extent permitted by applicable law, in no event shall Us, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including but not limited to damages for loss of data, loss of photographs, loss of videos, or emotional distress resulting from the accidental or intentional deletion of media by the user through the Application.

9. Subscriptions, Pricing Tiers & Auto-Renewal (Apple / Google Terms)

ScrollPic offers optional access to premium features through auto-renewable subscription tiers:

  • Payment: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
  • Auto-Renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Billing Accounts: Your account will be charged for renewal within 24 hours prior to the end of the current period, and identify the cost of the renewal.
  • Subscription Management: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.

10. 3-Day Free Trial Policy

Where offered, new subscribers may activate a 3-Day Free Trial to evaluate Unlimited features. If you do not cancel the trial at least 24 hours before its expiration, your Apple or Google account will automatically convert into a paid auto-renewing subscription.

11. App Store Specific Legal Terms (Apple & Google)

You acknowledge that these Terms are concluded solely between you and Us, and not with Apple Inc. or Google LLC. Apple Inc. and Google LLC are not responsible for the Application, its content, maintenance, support services, or warranty claims.

12. DMCA & Copyright Safe Harbor Policy

We respect intellectual property rights. If you believe that any material within the Application or associated website infringes upon your copyright under the Digital Millennium Copyright Act, please send a formal DMCA Takedown Notice to copyright@scrollpic.app.

13. Indemnification

You agree to defend, indemnify, and hold harmless Us, its affiliates, licensors, and service providers from and against any claims, liabilities, judgments, awards, losses, costs, expenses, or legal fees arising out of your violation of these Terms.

14. Dispute Resolution & Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. You and ScrollPic agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Application shall be settled by binding, individual arbitration administered by the International Chamber of Commerce (ICC) or JAMS.

15. Governing Law & Severability

These Terms shall be governed by and construed in accordance with applicable local laws. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
